Law on Entrepreneurship

The law on business isa set of certain legal norms that are designed to regulate business (or related) relations. Legal norms affect the scope of such public relations as:

  • horizontal. That is, relations built on the principle of "entrepreneurial entrepreneur";
  • vertical. That is, relations built on the principle of "entrepreneur - the management body".

The Law on Entrepreneurship is based on the following principles:

  • freedom limited by some legalnorms. That is, each person can freely apply their property and abilities in order to realize entrepreneurial activity. Limitations are presented in the form of laws that are necessary to protect the rights, interests and health of others, the foundations of the constitutional order, as well as state security;
  • equality of the whole variety of forms of ownership. That is, any privileges are prohibited, as well as restrictions for persons who engage in entrepreneurial activities using property belonging to personal, state, and municipal property;
  • prohibition of monopoly. That is, the law on business provides, necessary for a market economy, freedom of competition;
  • correct understanding of goals. That is, the main incentive for entrepreneurial activity is profit;
  • compliance with the balance. That is, the law should regulate the interests of both the state as a whole and entrepreneurs;
  • principle of legality. That is, entrepreneurial activity must be implemented strictly in accordance with the relevant legal norms;
  • the principle of a single economic space. That is, on the territory of our country is prohibited the establishment of duties, customs borders or other obstacles to the free movement of financial means, products and services.

The Law on Entrepreneurship is divided into two parts. The general part includes the following items:

  • introduction to the subject;
  • distinctive characteristics of business law;
  • system of the law under consideration;
  • relations relating to business;
  • legal liability for violation of laws in the field of economy;
  • basic principles of rights created for entrepreneurs;
  • articles relating to the privatization of municipal and state property;
  • regulation of entrepreneurial activity at the state level;
  • protection of the rights and interests of persons engaged in business relating to property law.

The Law on Enterprises and Entrepreneurship also has a special part in its composition. It includes the legal regulation of such aspects as:

  • bankruptcy or insolvency of the enterprise;
  • monopoly and free competition;
  • market of goods. In particular, this is the quality of services, products;
  • price formation;
  • audit, accounting reports;
  • bank services, crediting, various calculations;
  • investment activities.

FZ on business is needed forIn order to provide businessmen with the necessary legal framework. Laws can prevent anarchy. Entrepreneurship appeared in modern Russia relatively recently, and therefore this sphere is still characterized by a low level of civilization. Appropriate laws and control over their compliance ensure the legal order and the possibility of successful business. At the moment, entrepreneurship is becoming more civilized.
